Privacy Policy

Diatom Studio Ltd (“Diatom”) has a policy to respect your privacy regarding any information we may collect while operating diatom.cc and through developing and supporting its Applications such as Flowpaper.

  1. Website Visitors. Like most website operators, Diatom collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Diatom’s purpose in collecting non-personally identifying information is to better understand how visitors use the Website and its services. From time to time, Diatom may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website. Diatom also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged-in users and for users leaving comments. Diatom only discloses logged-in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
  2. Application Users. Diatom may collect non-personally-identifying information about use of its Applications such as Flowpaper in order to understand the needs of its users and to make its Applications better. This information does not directly identify you and is information readably made available by the platform, this information may include but is not limited to IP address; Media Access Control (“MAC”) address; device software platform and firmware; mobile phone carrier; geographical data such as zip code, area code and coarse location; application usage data for example time spent in app and most used application features. Diatom may use the Flurry Analytics tool in order to develop and analyse use of the Services.   3. Gathering of Personally-Identifying Information. Certain visitors choose to interact with the Website or Applications in ways that require Diatom to gather personally-identifying information. The amount and type of information that Diatom gathers depends on the nature of the interaction. In each case, Diatom collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with the Website. Diatom does not disclose personally-identifying information other than as described below.
    1. Regarding Children. We do not intentionally gather personal information from visitors who are under the age of 13.
    2. PayPal. Those who engage in transactions with Diatom – for example, by making a donation to support the SketchChair project – do so using PayPal’s payments service. Additional information may be collected by PayPal during this process, but will not be passed on to us. Please read PayPal’s User Agreement and Privacy Policy for details on how this information is used.
  4. Aggregated Statistics. Diatom may collect statistics about the behavior of visitors to the Website or users of its Applications, and may display this information publicly or provide it to others. However, Diatom does not disclose personally-identifying information other than as described below.
  5. Protection of Personally-Identifying Information. Diatom takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information. Diatom will not rent or sell potentially personally-identifying and personally-identifying information to anyone. This information will only be disclosed in the situations described below:
    1. Information Disclosed to Third Party Service Providers. Diatom discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Diatom’s behalf or to provide services available at Diatom’s websites, and (ii) that have agreed not to disclose it to others, unless under similar conditions. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using the Website, you consent to the transfer of such information to them.
    2. Other Disclosures. Other than to its employees, contractors and affiliated organizations, as described above, Diatom discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Diatom believes in good faith that disclosure is reasonably necessary to protect the property or rights of Diatom, third parties or the public at large.
    3. Publishing Feedback. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.
    4. Sharing on Third Party Platforms. Diatom provides the ability for visitors to the Website or users of its Applications to access and use some third party platforms from within the Website and its Applications. Any use of these platforms, for example Facebook or Twitter, is subject to that specific platform’s Terms of Service and Privacy Policy.
  6. Cookies. A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Diatom uses cookies to help identify and track visitors, their usage of the Website, and their access preferences. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Website, with the drawback that certain features of the Website may not function properly without the aid of cookies.
  7. Business Transfers. If Diatom, or substantially all of its assets, were acquired, or in the unlikely event that Diatom goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Diatom may continue to use your personal information as set forth in this policy.
  8. Privacy Policy Changes. Diatom has the discretion to update this privacy policy at any time. When we do, we will revise the “last updated” date at the bottom of this page accordingly. We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
